Privacy Policy and Cookie Processing Principles of Bextr

These are the privacy principles ("Principles") of Lokk Parking s.r.o., ID: 07738803, headquartered at Zbraslavská 12/11, 159 00 Prague - Malá Chuchle ("Operator") for the Bextr platform operated at www.bextr.cz, info@bextr.com

The Principles describe how we handle the personal data of users of the Bextr service ("User") and the personal data of third parties communicated to us by Users, as well as how we work with cookies.

We divide Users into (i) those who submit requests for cooperation with influencers ("Client") and (II) those who offer such cooperation to Clients in the form of creating their own content and publishing it on social media ("Influencer").

Personal data means any information about an identified or identifiable natural person; an identifiable natural person is a person who can be directly or indirectly identified, in particular by reference to a specific identifier, such as name, identification number, location data, network identifier, or one or more specific elements of physical, physiological, genetic, mental, economic, cultural, or social identity of this natural person ("Personal Data").

The Operator is the data controller ("Controller") in relation to the Personal Data of Users.

Users may communicate Personal Data of third parties to the Operator through Bextr or direct communication. In relation to this Personal Data, the Operator is the data processor ("Processor").

When dealing with Personal Data, we comply with Regulation (EU) 2016/679 of the European Parliament and of the Council, the General Data Protection Regulation ("GDPR"), and Act No. 110/2019 Coll., on the processing of personal data ("PDPA").

We process the following personal data for influencers:

Name, surname, username, email address, and telephone number - These details are necessary for influencer identification.

Photograph - We obtain the photograph after connecting to the Instagram profile and display it to campaign clients for easier influencer identification.

For clients, we process the following personal data:

Name, surname, email address, and telephone number of the client, if provided by the client.

Information about individual campaigns - type of collaboration, budget, campaign name and description, campaign photographs, type of influencer.

Furthermore, as a result of using cookies, we may process the following Personal Data: IP addresses of devices from which you log in, and other selected data from system logs, information about the usage of our website and information about where you visited our website from, when you visited and left, or how many times you have visited our website, network identifiers assigned by us or services such as Instagram or Facebook, your usernames on these networks, and possibly associated emails, additional data provided in customer support communication, additional data entered into an application that may lead to your identification (e.g., direct messages).

The lawful basis for processing Personal Data is the performance of a contract between the User and the Controller according to Article 6 (1) (b) GDPR, the legitimate interest of the Controller in providing direct marketing (especially for sending commercial communications and newsletters) according to Article 6 (1) (f) GDPR, and consent to processing for the purposes of providing direct marketing (especially for sending commercial communications and newsletters) according to Article 6 (1) (a) GDPR in conjunction with Section 7 (2) PDPA.

We do not process Personal Data within the meaning of Article 9 GDPR (sensitive personal data).
The Controller retains Personal Data necessary for the performance of rights and obligations arising from the contractual relationship between the User and the Controller for the duration of the user account and then for a period of 10 years. For marketing purposes, only for the duration until consent to the processing of personal data is revoked, but no longer than for 5 years. For archiving purposes in accordance with relevant legal regulations, for a maximum period of 10 years.

Upon expiration of the above-mentioned period, the Controller will erase Personal Data.

Other Users will have access to Personal Data (in the scope of Name, Surname, Your information on social networks, portfolio, or insights) in order to fulfill the purpose of Bextr.

Personal Data (in the scope of information obtained from cookies) may be further provided to Google through Google Analytics.

Personal Data may be further provided to persons who are involved in ensuring the operation of Bextr (or providing other services for Bextr (accounting and other advisory services)) to the necessary extent.

Personal Data may only be transferred within the European Union. Under the conditions set out in the GDPR, the User has the right to access their personal data pursuant to Article 15 GDPR, the right to rectification of personal data pursuant to Article 16 GDPR, or if necessary, the right to restriction of processing pursuant to Article 18 GDPR, the right to erasure of personal data pursuant to Article 17 GDPR, the right to object to processing pursuant to Article 21 GDPR, the right to data portability pursuant to Article 20 GDPR, the right to withdraw consent to processing in writing or electronically to the address or email of the Controller.

Furthermore, the User has the right to lodge a complaint with the Office for Personal Data Protection if they believe that their right to the protection of personal data has been infringed.

Deleting the Client's profile automatically terminates the Agreement on Processing.

The Client is entitled to provide Personal Data of third parties to the Processor through Bextr or direct communication.

The Client acknowledges that in relation to this Personal Data, they themselves are in the position of the data controller.

The Processor contacts third parties only in connection with the Client's request and according to their instructions.

The Client agrees to the involvement of subprocessors. The Processor undertakes to ensure that additional processors or persons involved in the processing of Personal Data always meet a high standard of trust.

The Controller declares that it has implemented all appropriate technical and organizational measures to secure Personal Data.

The Controller states that only authorized persons have access to Personal Data.

The Operator uses cookies on this website for the purpose of targeted advertising, remembering login details, tracking website traffic, and specific events for visitor behavior statistics.

A cookie is a short text file that a visited website stores on your computer or mobile device. It allows the website to record information about your visit, such as preferred language and other settings. Subsequent visits to the website can thus be easier and more productive.

Cookies are important. Without them, browsing the web would be much more complicated. Cookies take up almost no disk space on your computer; their size is usually only a few kilobytes.

We also use services from our partners who also use cookies (e.g., Google Analytics, Google Tag Manager, Facebook). These cookies are controlled by third parties, and we do not have access to read or write data stored in them. These are mainly systems for delivering advertising or analyzing visitor traffic.

On Bextr, we may request your consent to the use of cookies. You can revoke this consent at any time through your browser settings. To disable cookies, you must change the settings of your web browser and reject cookies. The process of rejecting cookies varies depending on the browser you use.

The Operator has the right to change these Policies at any time. The Operator will announce the change of Policies on the Bextr website.

These Policies take effect as of May 7, 2024.
